Currency UK Ltd. Affiliate Programme Terms & Conditions.

  1. The programme is open to businesses, organisations, companies and Currency UK account holders.
  2. Membership of the programme is free.
  3. Once registered, Currency UK Ltd will pay commission to programme members for each referral of a new customer; each time that customer completes a qualifying transaction as defined below:
    • A qualifying transaction is a foreign exchange transaction carried out by a Currency UK foreign exchange dealer with an equivalent value in excess of GBP 5,000.
    • The purchase of cash and travellers cheques from the Currency UK Cash Online service is not a qualifying transaction.
  4. Commission will be paid to the referring member as a percentage of the gross profit generated by Currency UK Ltd on each qualifying transaction by customers referred by that member, on the following basis.
    • Bronze Level: 15% of gross profit on the first, second and third transactions carried out by referred customers.
    • Silver Level: 20% of gross profit on the fourth to the eighth transactions carried out by referred customers.
    • Gold Level: 25% of gross profit on the ninth and subsequent transactions carried out by referred customers.
  5. The Affiliate Programme also features a ‘member get member’ referral, where one member introduces a new member who joins the programme.
  6. In the case of a member get member referral, the newly introduced member will receive commission as detailed in 4 above. The introducing member will also receive commission on qualifying transactions of customers referred by members who they have directly introduced to the Affiliate Programme. ‘Second tier’ commission will be paid to the introducing member as a percentage of the gross profit generated by Currency UK Ltd on each qualifying transaction referred by the introduced member on the following basis.
    • All Levels: 5% of gross profit on all transactions carried out by customers referred by the introduced member.
  7. A ‘qualifying referral’ requires that the name and contact details of a new customer be passed to Currency UK Ltd by one of the following methods:
    • Written or Verbal referral: E-mail, fax, letter, or, at the discretion of Currency UK Ltd, by telephone.
    • Online referral: A click through by a customer to the Currency UK Ltd website from a programme member’s website, where:
      • The Affiliate Programme member has used, on their website, link(s) using specific code, unique to that member, and supplied by Currency UK Ltd.
      • The referred party submits their details using the customer or affiliate registration form on the Currency UK Ltd website within 30 days of the click through from the programme member’s website
    • In the event that a referred customer contacts Currency UK Ltd with a complaint regarding the conduct of a referring affiliate and requests that commission on their transactions are no longer paid to that referring affiliate Currency UK Ltd may at its sole discretion discontinue commission payments to the affiliate for that specific customer.
  8. A ‘new customer’ is one that is not already an existing Currency UK Ltd account holder or Affiliate Programme member, or one that has not previously requested account opening information from Currency UK Ltd via the website, e-mail, fax, letter or telephone.
  9. A ‘new Affiliate Programme member’ is one who has not previously registered with the Affiliate Programme via the website, e-mail, fax, letter or telephone.
  10. The online referral system places a tracking ‘cookie’ on the referred party’s computer, a qualifying online referral can only be made where this tracking cookie is present and correct on the referred party’s computer being used at the time of the submission of information detailed in 7.b.ii above.
  11. The Affiliate Programme member is responsible for displaying or communicating any notices required by law regarding the placing of cookies on individuals computers by links placed on their websites.
  12. Currency UK Ltd’s decision in the qualification of referrals and the validity of new customers and Affiliate Programme members is final; however, copies of supporting documentation will be made available to the referring Affiliate Programme member on request.
  13. Affiliate Programme members may choose to receive commission in GBP, EUR or USD paid into their nominated bank account or by cheque in GBP only.
  14. Electronic funds transfer payments are subject to a minimum of GBP 200 (or currency equivalent). Cheques are normally subject to a minimum of GBP 10.
  15. Details of commission earned and other performance statistics will be made available to the member online via the member’s individual Admin system. During the term of this agreement and for 12 months following termination of this agreement, you agree to keep all commission and performance information provided via the Admin system, or by any other method, confidential and not to disclose such information to third party organisations.
  16. In the case of payment by electronic funds transfer, where the outstanding amount is less that GBP 200, the balance will be carried forward to the following month. Alternatively, a cheque, drawn in GBP only, for the outstanding balance will be sent on request. In the case of payments normally made by cheque, where the outstanding amount is less that GBP 10, the balance will be carried forward to the following month, except where payment is specifically requested by the member.
  17. Acceptance of application for membership is at the sole discretion of Currency UK Ltd. Currency UK Ltd may refuse a membership application without giving a reason.
  18. Currency UK Ltd use e-mail as the primary method of communication with Affiliate Programme members. You give us permission to send you programme and marketing information by e-mail. Affiliate Programme members may replicate e-mailed marketing information for onward transmission to their contacts, however, the use of unsolicited junk e-mail, or spam, by Affiliate Programme members to promote Currency UK Ltd and its services to third parties is strictly forbidden. Any complaints received regarding a member’s misuse of e-mail will result in the immediate suspension of membership and if substantiated, termination of this agreement.
  19. The term of this Agreement will begin upon our acceptance of your Affiliate Programme application and will end when terminated by either party. Either party may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. You are only eligible to earn referral commission on qualifying transactions occurring during the term.
  20. Currency UK Ltd may modify any of the terms and conditions contained in this Agreement, at any time and at their sole discretion, by posting a change notice or a new agreement on their website. Modifications may include, for example, changes in the scope of available referral commission, commission schedules, payment procedures and programme rules. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the programme following the posting of a change notice or new agreement on the Currency UK Ltd website will constitute binding acceptance of the change.
  21. Currency UK Ltd will not be liable for indirect, special or consequential damages, or any loss of revenue, profits or data, arising in connection with this Agreement or the programme, even if they have been advised of the possibility of such damages. Further, their aggregate liability arising with respect to this Agreement and the programme will not exceed the total referral fees paid or payable to you under to this Agreement.
  22. You acknowledge that you have read this agreement and agree to all its terms and conditions. You understand that Currency UK Ltd may at any time (directly or indirectly) solicit customer referrals on terms that may differ from those contained in this agreement or operate websites that are similar to or compete with your web site. You have independently evaluated the desirability of participating in the programme and are not relying on any representation, guarantee or statement other than as set forth in this agreement.
  23. This Agreement will be governed by the laws of England, without reference to rules governing choice of laws. You may not assign this Agreement, by operation of law or otherwise, without the prior written consent of Currency UK Ltd. Subject to that restriction, this Agreement will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns. Currency UK Ltd’s failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of their right to subsequently enforce such provision or any other provision of this Agreement.
